Kith and Kin, LLC (“Company”, “We,” “Us,” and “our”) respects your privacy and is committed to protecting it through compliance with this privacy policy (“Policy”).

This Policy describes the types of information We may collect from you or that you may provide when you visit the website www.kithandkin.app (our “Website”) or purchase, download, install, access, or use the Kith + Kin progressive web or mobile application (our “Application”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies to information we collect:

  • On our Application. 

  • In email, text, and other electronic messages between you and our Website and/or Application.

  • Through any other mobile and desktop applications you download from our Website, which provide dedicated non-browser-based interaction between you and this Website.

  • Us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or

Children Under the Age of 13 

Our Website and our Application are not intended for use by children under 13 years of age. No one under age 13 may provide any information to or on our Website or our Application. We do not knowingly collect personal information from children under 13. We may also partner with selected third-party vendors such as Google Analytics, and others, to allow tracking technologies and remarketing services on the Website or our Application through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Website or our Application to determine the popularity of certain content and better understand online activity. What types of cookies do we use?

  • To fulfill the purpose for which you provide it.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce or apply our Website Terms of Use or End User License Agreement and other agreements, including for billing and collection purposes.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Kith + Kin, our customers, or others. This may include exchanging information with other companies and organizations for the purpose of fraud protection and credit risk reduction.

We keep your information for as long as we need it to carry out the purpose for which it was collected, or as required by applicable laws and regulations. We may retain your questions and feedback in order to improve our Website, our Application, or our services. Do not send us any information, ideas, suggestions, proposals or comments that you consider confidential or that you wish to be treated as confidential.

Choices About How We Use and Disclose Your Information 

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

  • Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to hello@kithandkin.app. This opt out does not apply to information provided to the Company as a result of a product purchase, product service experience, or other transactions.

  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by sending us an email stating your request to hello@kithandkin.app.  

  • Location Information. You can choose whether or not to allow the Application to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the Application may become inaccessible or not function properly.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. 

Accessing and Correcting Your Information

You can review and change your personal information by logging into your account on our Website or our Application and visiting your account profile page.

You may also send us an email at hello@kithandkin.app to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Rights of Certain Users

Subject to local law, you may have certain rights with regard to your personal information. To learn more about the personal information we collect about you or the rights you may have, please contact us at the contact information below. These rights may include the following rights to (1) access or rectify your personal information or request its deletion, (2) request a restriction on the processing of your personal information, (3) object to the processing of your personal information, or (4) exercise other rights with respect to your personal information. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. While we strongly encourage you to first raise any questions or concerns about your personal information directly with us, you may have a right to lodge a complaint with the relevant supervisory authority.

International Users

Our offices and business are in the U.S., and our Website and our Application is hosted in the United States and is intended for users in the U.S.  If you are a consumer accessing our Website or our Application or using our services from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use and disclosure that differ from U.S. laws, your continued use of our Website, our Application and/or services, which is governed by U.S. law and these terms, indicates your consent to transfer of your personal information to the U.S.

California and Specific States

Section 1798.83 of the California Civil Code requires select businesses to disclose policies relating to the sharing of certain categories of customers’ personal information with third parties. These businesses are required to accept requests for disclosures of these policies from customers but are only required to honor one request per calendar year. Businesses have thirty (30) days to respond to each inquiry to the designated address. Each inquiring customer will receive an explanation of the categories of customer information shared and the names and addresses of any third-party businesses. In limited circumstances, customers’ failure to submit requests in the manner specified will not require a response from the business.

If you are a California resident, you may request such information from us by sending a letter to 24 Longacre Drive, Collegeville, PA 19426.  In your letter, please provide your name, address, and email address, as well as a request that we provide such information to you, by using the following or similar language, “I request that Kith + Kin provide its third party information sharing disclosures required by section 1798.83 of the California Civil Code.”

Data Security

Kith + Kin takes commercially responsible steps to protect and secure the information we collect and store about our users.  We have implemented measures which are designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.  The servers that run our application employ full disk encryption.  All communications between your device(s) and our servers, including transmission of sensitive information such as social security number or sensitive health information, are encrypted using 2048-bit secure socket layer technology (“SSL”).  We also use HTTP strict transport security to add an additional layer of protection for users.  

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website or our Application, you are responsible for keeping this password confidential. We ask you not to share your password, PIN or security questions and answers with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website and our Application. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Website or our Application.
